Rental Agreement CUCHARA VACATION RENTALS RENTAL AGREEMENT GUEST AND OCCUPANCY LIMITS: The Maximum number of Guests allowed to stay at the property is the amount listed in the Guest Information portion of your agreement. Occupancy exceeding this limit will result in immediate eviction and forfeiture of all amounts paid. The Guest reserving the Property must be at least 25 years of age and will be held responsible for all other parties and/or guests of the Guest for compliance with this Agreement, with listed policies, ordinances, rules, and regulations and for any losses incurred by Cuchara Vacation Rentals or to the Property due to negligence or vandalism. WEDDINGS, GATHERINGS, REUNIONS, RECEPTIONS AND/OR PARTIES ARE NOT ALLOWED.
UPDATES TO RESERVATION: If you need to adjust the number of Guests or Pets for your reservation, please notify us prior to check in day. That way we can make the appropriate adjustments before we charge you for the final balance.
PAYMENT: Your balance is due the day you check in, we will authorize the Credit Card on file for the balance due. PLEASE BE SURE THAT THE CREDIT CARD WE HAVE ON FILE (THE CARD YOU USED TO MAKE THE RESERVATION) IS STILL VALID. If not, please notify us prior to check in day with a valid card. If you wish to make other payment arrangements, contact us prior to your arrival date.
CANCELLATIONS: If for any reason, the Guest cancels this Agreement more than 30 days from the Arrival Date, the Reservation Deposit will be refunded. If less than 30 days from the Arrival Date, the Reservation Deposit required upon booking will be forfeited. No shows will be charged the full rental amount.
CHECK IN AND CHECK OUT: Check in time is 3:00 pm or later the day of arrival. Check out time is 10:00 am or earlier the day of departure. Sometimes we can accommodate an early check in or a late check out. Please notify us the night before arrival and if the property is ready, you’re welcome to check in early. As far as late check out goes, notify us the night before departure and we’ll do our best to accommodate your late check out.
CONDUCT: Our properties are privately owned and are often located in a subdivision or near other cabins. We ask that you and your guests treat the property with respect as well as the neighbors. No parties, loud music or gatherings of any kind are allowed. There will be no disturbing the peace or acts creating a nuisance or loud or unusual noises or intoxication in or about the premises at any time. Quiet time is from 10:00 pm to 7:00 am.
SMOKING, OUTDOOR FIRES & FIREWORKS: Smoking is strictly forbidden inside the Property. Smoking is only allowed “outside”. PLEASE dispose of cigarette butts responsibly, do not throw butts on the ground or into the woods. Carelessness could start a forest fire! Evidence of smoking inside the Property or butts thrown outside will result in immediate eviction and forfeiture of all amounts paid and will result in a Cleaning Fee as an Excess Damage Cost and will be charged against the credit card on file. OPEN FIRES, FIREPITS, CHARCOAL GRILLS & FIREWORKS ARE NOT PERMITTED AT ANY TIME.
FIREPLACES AND BBQ GRILLS: We do not supply firewood for fireplaces or wood stoves. If the property has firewood on site, you’re welcome to use it. You can purchase firewood in the Cuchara Village at Dakota Dukes or in LaVeta at the Big R store. Please keep screens closed on fireplaces and doors closed on woodstoves at all times. Most of our properties have either a Propane Grill or an Electric Grill. Please turn the propane off at the tank after each use and clean BBQ grill before departing. We supply propane for the grills. If at any time you need a full tank, just give us a call and we’ll bring one over.
GREEN SPACE: Please respect the natural outdoor environment of the property. Do not park on the grass. Do not carve on trees or build forts. Respect the open space of the community. No unauthorized motor vehicles permitted in common areas of subdivisions or on private property.
CHILDREN: Children must be supervised at all times. Severe injury or death could result from failure to properly supervise the children. Children must be supervised around ponds, creeks & rivers, hot tubs, fireplaces & wood stoves & high decks. Do not allow your children to build fires or stoke fires in the fireplace or wood stove. The home is NOT CHILD PROOF and requires children to be constantly supervised.
PETS: Pets are not allowed in or on the Property unless Guest has prior approval. With approval, we only allow well behaved dogs. No cats, birds, reptiles, or any other animals allowed. If you are bringing a pet, you must read and agree to our pet policy.
INTERNET & TV: Most of our properties have Wi-Fi and TV. Please be sure to look on our website to see what Wi-Fi or TV service is available at the property you have reserved. Some may or may not have Wi-Fi. Some may have Satellite TV or may only have Internet TV. Properties that have Internet TV will require you to have your own personal account and passwords for Netflix, Amazon Prime, Hulu, etc. Please be aware that Cuchara is in a remote mountain area and outages of Wi-Fi, TV or even Electricity can occur and are beyond our control. THE WI-FI NETWORK AND PASSWORD WILL BE POSTED ON THE REFRIGERATOR AT EACH PROPERTY.
KITCHENS & SUPPLIES: Our Kitchens are Fully Equipped with Dishes, Pots & Pans, Utensils, Microwave, Coffee Maker, Stove/Oven, and Refrigerator. Some units have more appliances. We provide Linens & Towels and a STARTER PACK of supplies. This starter pack is not intended to last the duration of your stay. The starter pack consists of the following: Shampoo, bath soap, liquid hand soap, 2 rolls of toilet paper per bathroom, 1 paper towel roll, liquid dish soap, automatic dish soap, dish sponge, garbage bags and a small amount of laundry detergent. You can purchase additional supplies at our local markets in LaVeta, or Walsenburg. GARBAGE DISPOSALS are to be used for small food remnants left on dishes. Anything other than small food particles will cause the device to become jammed. If the device becomes jammed/damaged and there’s evidence of misuse, the cost for the repair/and or replacement will be your responsibility. DO NOT POUR GREASE DOWN THE DRAIN. Wipe or pour your cooking grease into a container and place into the trash.
TRASH: Upon arrival, when you pick up your envelope & keys there will be instructions on your envelope for trash. Some properties have a dumpster available with a code and some properties we require you to call or text for trash pickup. Please leave trash inside the property until it is hauled off. DO NOT leave any trash or food outside at any time because it attracts bears and other wildlife. DO NOT feed the BEARS!
ATV’S, RV’S & TRAILERS: Federal, State, and County law forbids the use of ATV’s on Forest Service Roads, State Highway 12 and County Roads. Off-highway vehicles, such as ATV’s and individuals are subject to citations & fines. Please trailer your ATV’s to access legal Forest Service trails located in the San Isabel National Forest. Most of our properties have space for parking a trailer. Please notify us prior to arrival if you’re bringing a trailer so that we can help you park in a designated area. NO RV’S OR CAMPING TRAILERS ALLOWED ON THE PROPERTY.
HEATING & AIR CONDITIONING: All our properties have a source of heat. None of our properties have Air Conditioning. If you’re warm in the property, open the doors and windows for a few minutes and it’ll cool off. With our high altitude and cool mountain air, temperatures will be much cooler than most places. If you’re away from the property or checking out, please turn heat off and close & lock the doors and windows. Please be conservative and don’t have the heat on with the windows open.
FURNISHINGS WEAR AND TEAR: Guest agrees not to move or alter any of the furnishings and use them only for the purpose intended. Guest agrees to respect and protect all furnishings and décor and understands that some of the furnishings are unique and valuable. Guest is solely responsible for replacement value for any damage or destruction to furnishings. Care should be taken not to damage the furniture with wet or soiled clothing. Please do not walk into the home with muddy or dirty feet. NO PETS ALLOWED ON FURNITURE.
FAILURE OF A SYSTEM, AMENITY OR APPLIANCE: Please immediately report any failure of a system, amenity, or appliance - including but not limited to water, sewer, electrical, heating, refrigeration, laundry equipment, electronic or entertainment equipment or service. We will do our best to fix or repair the problem as soon as possible. Keep in mind that Cuchara is in a rural mountain area and sometimes getting parts and or service takes more time. Guest understands and accepts the facts that the property is leased for its rural mountain appeal and not its modern conveniences, and therefore some systems, amenities and appliances may not be always fully functional, and it may be unreasonably difficult or impossible to get a malfunctioning system, amenity or appliance operating within the rental/lease period.
DAMAGE, REPAIR, MISSING ITEMS AND EXCESS CLEANING: The Guest acknowledges that Cuchara Vacation Rentals will charge their credit card for any damage to the property, theft, unauthorized pets, late check out without prior approval, excessive cleaning inside or outside, and smoking. Any excess damage costs will be charged immediately to the Guest’s credit card on file. Guest assumes full responsibility for any items found to be missing and any damage due to misuse, negligence or action on Guest's or Guest’s visitors part, except in the case of normal wear-and tear. (If for some reason the credit card provided by the Guest is no longer valid, then the Guest must provide another credit card or alternate form of payment to cover the costs for any of the above mentioned).
SUBSTITUTE: Please keep in mind our cabins and condos are privately owned. We reserve the right to substitute. Units do encounter unforeseen damage or mechanical failure that can temporarily remove them from being available. In this event, we will provide you with the most comparable accommodations. We will not charge you additional if you are placed in a more expensive unit and will charge you the lower rate if you are placed in a less expensive unit. There will be no refunds or discounts if we must substitute a unit.
INDEMNIFICATION AND INSURANCE: Guest agrees to indemnify and hold harmless Cuchara Vacation Rentals, the Owner of the Property, and Representatives thereof, from any and all liability, claims, loss, property damage, expenses, including attorney fees and disbursements arising by reason of any injury, death or damage sustained by any person, or to the property of any person, in or on the Property during the Term of this Agreement, including Guest, additional invitees or visitors of Guest, where such injury, death or damage is caused by a negligent or intentional act of Guest, additional guest or any of Guest’s visitors or invitees. Guest agrees to waive any claim whatsoever and hold harmless Cuchara Vacation Rentals, its Representatives and Property Owner for accidents and claims resulting from accidents and or injury arising from use of the rental property and any of its porches, decks, stairs, parking areas, equipment, etc. Guest is encouraged to secure the appropriate travelers or vacation insurance and/or renter’s insurance.
ACTS OF NATURE: Acts of nature causing poor weather conditions or temporary power outages are not cause for refund or partial refund. In the event of road closures or mandatory evacuation, guests who have not arrived will be refunded their deposit. Guests that have already checked in will not be held responsible for the remainder of their stay.
CAUSE FOR EVICTION: The Guest and all parties with the Guest will be subject to immediate eviction from the Property if the Guest or parties of the Guest violate any terms of this Agreement, including but not limited to, violation of the occupancy limits, unauthorized pets, smoking, or excessive noise. In the event of eviction from the Property, the Guest shall forfeit all amounts paid and there will be no refund of money.
ATTORNEY’S FEES AND COSTS: If Manager employs the services of an attorney to enforce any conditions of this Agreement, to collect any amounts due, the eviction of the Guest, or because Guest takes any action to recover deposits not due, Guest shall be liable to Cuchara Vacation Rentals for reasonable attorney's fees and costs incurred by Manager.
FALSIFIED RESERVATIONS: Any reservation obtained under false pretense will be subject to forfeiture of Reservation Deposit and Final Balance, if paid, and such party will not be permitted to check in and/or will be subject to immediate eviction with the forfeiture of all amounts paid.
GENERAL TERMS: This Agreement is made in, and shall be governed solely by the laws of, the State of Colorado and Colorado Statutes. Venue for enforcement shall be Huerfano County, Colorado. If any section, clause, paragraph, or term of this Agreement is held or determined to be void, invalid or unenforceable, for any reason, all other terms, clauses, or paragraphs herein shall be severed and remain in force and effect. This Agreement is taken in full compliance with Federal, State, and local Fair Housing Laws, without regard to race, color, religion, sex, country of origin, handicap, or familial status.
ACKNOWLEDGMENT: Guests are responsible for reading and understanding all the terms and conditions in this agreement prior to checking in. Reserving, providing credit card information and/or checking into your unit implies that you agree, understand and are willing to comply with the Cuchara Vacation Rental Agreement and our Pet Policy.
Pet Policy WE ONLY ALLOW DOGS IN CERTAIN APPROVED UNITS. All other animals and/or pets are NOT permitted. We only allow well behaved dogs. No cats, birds, reptiles, or any other animals allowed. During your reservation, whether it be online or by phone, you must declare your dog(s) so that we know how many you will be bringing. Under no circumstances may any animal and/or pet be kept on the Property, even temporarily, without consent of Cuchara Vacation Rentals.
GUESTS AGREE TO COMPLY WITH THE FOLLOWING: All dogs must be 1 year old or older. All dogs must be leashed at all times. Guest must clean up all pet refuse in the yard, driveway, etc. PLEASE! DOGS ARE NOT ALLOWED ON FURNITURE AT ANY TIME. Any evidence of dogs on furniture may incur extra cleaning or damage fees. All dogs must be treated with Flea and Tick Repellent. Dogs must not cause damage to premises or furnishings. If damages are caused, the cost of the damage will be charged to your credit card. BARKING OR GROWLING DOGS ARE NOT ALLOWED. Guests will be asked to leave if their barking / growling dog is not controlled. No refund will be given for unused days and time. Guests must prevent dogs from producing excessive noise at a level that disturbs neighbors. Dogs will not be left unattended for an undue length of time, either indoors or out. Dogs will not be left unattended on balcony, patio, or porch. IF DOG IS LEFT UNATTENDED ON PREMISES, GUEST AGREES TO KENNEL THE DOG IN A CARRIER ON A TILE OR WOOD FLOOR. Cuchara Vacation Rentals and the Homeowner assumes no responsibility for illness or injury that may incur to pets or humans while on the premises.
